Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the CallEmBack website and service ("CallEmBack", "we", "us"). By creating an account or using the service, you agree to these Terms. If you use CallEmBack on behalf of a business, you confirm you are authorized to bind that business to these Terms.

2. What the service is

CallEmBack provides a dedicated business phone number and software that, when you choose to forward your unanswered calls to that number, answers those calls with an automated AI voice assistant acting on your business's behalf, collects the caller's request, and shows it to you in a dashboard and by email. Call forwarding is configured by you on your own device and can be disabled by you at any time. CallEmBack is a communication tool — you remain responsible for your business, your customer relationships, and the work you perform.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate business information — your callers are greeted in your business name.

4. Acceptable use

You agree to use CallEmBack only to respond to people who have contacted your business, and to comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and carrier messaging policies. You must not use CallEmBack for bulk marketing, cold outreach, spam, harassment, or any unlawful purpose. Opt-out requests (such as "STOP") are honored automatically and you must not attempt to circumvent them. We may suspend accounts that generate spam complaints or violate carrier rules.

5. Subscriptions, trials and billing

Paid plans are billed monthly or annually in advance. New accounts may include a free trial; you will not be charged until the trial ends. You can cancel anytime from your account — cancellation takes effect at the end of the current billing period, and we do not charge you further. Fees for a started billing period are non-refundable except where required by law; if something went wrong on our side, contact us and we'll make it right.

6. Service availability and limitations

Call handling and message delivery depend on mobile carriers, networks and other third parties outside our control. We do not guarantee that any particular call will be answered or any message delivered or read, or that the service will be uninterrupted or error-free. CallEmBack is not an emergency service and must not be relied upon for emergency communications. You acknowledge that missed communications can occur even when the service functions as designed.

7. Limitation of liability

To the maximum extent permitted by law: CallEmBack is provided "as is" and "as available", without warranties of any kind; we are not liable for lost profits, lost business opportunities, lost data, or any indirect, incidental, special or consequential damages — including business lost due to unanswered calls or undelivered messages; and our total aggregate liability for any claim arising out of the service is limited to the amount you paid us in the three (3) months preceding the claim.

8. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your call forwarding remains under your control on your own device (you can disable it with a carrier code at any time).

9. Changes

We may update these Terms as the service evolves. If changes are material, we will notify you by email or in the app before they take effect. Continuing to use the service after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
